TERMS OF SERVICE

These Terms govern access to the Lumiscent website and purchases made directly from Lumiscent.

References to “Lumiscent,” “we,” “us” and “our” mean Lumiscent. References to “you” mean the website visitor or customer.

By using the website or submitting an order, you agree to these Terms and the policies incorporated into them. Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

1. Eligibility and accounts

You must have legal capacity to enter a binding contract or act with the permission of a person who does.

You must provide accurate, current and complete information. You are responsible for safeguarding your account credentials and for activity carried out through your account unless it results from our breach of duty.

You must notify us promptly if you suspect unauthorised access.

We may suspend or restrict an account where reasonably necessary to address fraud, security, unlawful activity, abuse or a material breach of these Terms. This does not remove rights concerning an order already accepted.

2. Product information

We take reasonable care to describe products accurately. Images, colours, proportions, finishes and packaging may appear different because of lighting, photography, screen settings, manufacturing tolerances or packaging updates.

Minor differences that do not materially affect a product’s identity, quality or function will not necessarily constitute a defect.

Fragrance perception is subjective. Scent strength, character, throw and longevity may vary depending on the room, ventilation, temperature, diffuser settings, oil quantity and individual perception. Descriptive terms and “inspired by” references describe fragrance style and do not promise an exact match to another product, venue or person’s perception.

We may update packaging, labels or non-material specifications without notice. Any substitute supplied will have materially equivalent functionality and will not reduce your statutory rights.

3. Safe and proper use

You must follow all product instructions, warnings and maintenance guidance.

You must:

Use a diffuser only for its intended purpose;
Use a compatible power supply;
Position it safely and securely;
Keep oils away from children, pets, flames and vulnerable surfaces;
Avoid overfilling, spilling or ingesting oil;
Use oils and dilution ratios suitable for the product; and
Clean and maintain the diffuser as instructed.

You are responsible for loss or damage caused by misuse, neglect, unauthorised modification, unsuitable oil, improper maintenance or failure to follow clear safety instructions, to the extent permitted by law.

Product information does not replace appropriate medical, veterinary or professional advice. People with allergies, sensitivities, respiratory conditions, pets or other particular concerns should assess suitability before use.

4. Orders and contract formation

Submitting an order is an offer to buy from Lumiscent.

An automated order acknowledgement or payment authorisation confirms receipt of your order but does not necessarily mean that we have accepted it.

A binding sales contract is formed when we send a dispatch confirmation or otherwise expressly confirm acceptance. Each dispatched package may form a separate contract.

Before acceptance, we may decline, limit or cancel an order for a legitimate reason, including:

Lack of stock;
A pricing or description error;
Payment failure;
Suspected fraud or unauthorised payment;
Abusive purchasing or returns activity;
Unusually large quantities;
Suspected unauthorised resale;
Delivery restrictions;
Sanctions or legal requirements; or
An inability to fulfil the order safely or lawfully.

If payment has been taken for an order we do not accept, we will refund the relevant amount.

After acceptance, we will cancel only as permitted by the contract or applicable law.

5. Prices and payment

Prices are displayed in pounds sterling and include applicable UK taxes unless stated otherwise.

The price payable is the price presented at checkout when you submit the order, subject to correction of an obvious error before the contract is accepted.

We are not required to supply a product at an obviously incorrect price where you knew, or reasonably should have known, that the price was an error.

You confirm that you are authorised to use the selected payment method. We may use payment-verification and fraud-prevention checks before accepting an order.

Products remain our property until full payment has been received. This does not alter when delivery risk passes to you.

6. Promotions and discount codes

Promotions, bundles, gifts and discount codes may be subject to additional conditions displayed with the offer.

Unless stated otherwise:

Only one discount code may be used per order;
Codes cannot be exchanged for cash;
Codes cannot be applied retrospectively;
Discounts apply only to eligible products;
Delivery charges, gift cards and excluded products do not qualify;
A code may be personal and non-transferable;
Codes have no value after expiry;
Discounts are calculated against the amount actually payable; and
Refunds will never exceed the amount actually paid.

We may withdraw or correct a promotion before accepting an order. We may cancel a discount obtained through error, manipulation, unauthorised publication, multiple-account abuse or breach of the promotion’s conditions.

If part of a discounted bundle is returned, we may recalculate the retained products at the applicable non-bundle price and adjust the refund where the promotional terms and law allow.

7. Delivery

Delivery dates and timeframes are estimates unless we have expressly agreed that a specific date is essential.

We are not responsible for delay caused by circumstances outside our reasonable control, but we will comply with any mandatory rights you have if delivery is delayed.

You must provide a complete and accurate address and cooperate with reasonable delivery requirements.

For consumer orders, risk normally passes when you or a person identified by you takes physical possession of the goods. If you independently appoint a carrier that we did not offer, risk may pass when the goods are delivered to that carrier.

If delivery fails because you provided incorrect information, refused delivery or failed to collect or cooperate, we may charge reasonable redelivery, storage or return costs where legally permitted.

Refusing or failing to collect a parcel does not necessarily constitute valid cancellation. Statutory cancellation must be communicated clearly.

For international deliveries, you are responsible for import eligibility, local restrictions, duties and taxes unless checkout expressly states that these are included.

8. Returns, cancellations and faults

Returns, statutory cancellation rights, faulty-product remedies and the Lumiscent commercial warranty are governed by our Return and Refund Policy.

That policy forms part of these Terms. If these Terms conflict with a mandatory consumer right, the mandatory right prevails.

9. Subscriptions

Where a subscription or recurring-purchase option is offered, the product, price, billing frequency and minimum commitment, if any, will be shown before purchase or in the applicable subscription terms.

You authorise recurring charges in accordance with the option selected. You are responsible for keeping payment and delivery details current.

Cancellation and renewal rights are governed by the subscription terms presented at sign-up and any mandatory law. Cancelling a subscription does not normally reverse an order that has already been processed or dispatched.

10. Reviews and submitted content

If you submit a review, photograph, comment or other content, you confirm that:

It is accurate to the best of your knowledge;
You have the right to submit it;
It does not infringe another person’s rights;
It is not unlawful, threatening, deceptive or defamatory; and
Any commercial relationship or incentive has been properly disclosed.

You retain ownership of your content. You grant Lumiscent a worldwide, non-exclusive, royalty-free, sublicensable licence to store, reproduce, publish, display, adapt for formatting and use that content in connection with operating, advertising and promoting Lumiscent and its products.

We may moderate or remove content for a legitimate reason, including illegality, abuse, irrelevance, infringement, disclosure of personal information or failure to comply with these Terms. We will not suppress a genuine review merely because it is negative.

11. Intellectual property and permitted use

The website and its content—including branding, product names, logos, photographs, graphics, text, layouts and original product descriptions—are owned by or licensed to Lumiscent and protected by applicable law.

You may use the website for personal shopping purposes.

Without our prior written permission, you must not:

Reproduce, republish or commercially exploit our content;
Copy product photography or original descriptions;
Use our trade marks or branding;
Scrape, harvest or systematically extract website data;
Use automated systems in a way that burdens or disrupts the website;
Circumvent security or access controls;
Misrepresent an affiliation with Lumiscent; or
Use our protected content to train or develop a commercial machine-learning system.

Nothing transfers intellectual-property ownership to you.

12. Prohibited conduct

You must not use the website:

Unlawfully or fraudulently;
To distribute malware or harmful code;
To interfere with security or operation;
To impersonate another person;
To obtain unauthorised access;
To submit false payment, delivery or identity information;
To abuse promotions, returns or customer accounts; or
To infringe another person’s rights.

We may take proportionate steps to prevent or investigate prohibited activity.

13. Third-party services and links

The website may contain services, integrations or links operated by independent third parties.

We do not control and are not responsible for an independent third party’s content, availability or conduct. Your use of its services may be governed by separate terms.

This does not exclude responsibility where the third party acts on our behalf in circumstances for which the law makes us responsible.

14. Shopify

Shopify supplies the ecommerce platform supporting our store. Your purchase contract is with Lumiscent unless checkout clearly states otherwise.

Shopify is not the seller of Lumiscent products and does not assume Lumiscent’s obligations to customers merely by providing the platform.

15. Website availability

We may maintain, alter, suspend or withdraw website features where reasonably necessary for security, maintenance, legal, technical or business reasons.

We do not promise uninterrupted or error-free website availability. We are not responsible for losses caused solely by events outside our reasonable control, subject to any responsibility that cannot legally be excluded.

Website content is provided for general information. You should verify information that is material to a purchasing decision through the product listing or by contacting us.

16. Our liability to consumers

We do not exclude or limit liability where doing so would be unlawful, including liability for:

Death or personal injury caused by negligence;
Fraud or fraudulent misrepresentation;
Breach of statutory rights relating to goods; or
Any other liability that cannot legally be excluded.

If you are a consumer, we are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill. Loss is foreseeable where it was an obvious consequence or was contemplated by both parties when the contract was formed.

We are not responsible for loss that is not foreseeable, results from your misuse or failure to follow instructions, or could reasonably have been avoided by you.

Our products are supplied for private and domestic use unless we agree otherwise in writing. We are not responsible to a consumer for business losses, loss of profit, loss of revenue, loss of opportunity or business interruption arising from domestic use.

Nothing in this section affects your mandatory consumer rights.

17. Business customers

If you purchase wholly or mainly for business purposes, the following provisions apply to the extent permitted by law:

All implied terms are excluded to the fullest extent legally permitted;
Lumiscent is not liable for loss of profit, revenue, business, contracts, anticipated savings, goodwill, data or any indirect or consequential loss;
Our aggregate liability arising from an order will not exceed the amount paid for that order; and
You will be responsible for reasonably foreseeable losses caused by your unlawful use of the website, infringement of our intellectual-property rights or material breach of these Terms.

Nothing limits liability that cannot legally be limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

18. Events outside our control

We are not responsible for failure or delay caused by an event outside our reasonable control, including severe weather, carrier disruption, utility or network failure, industrial action, epidemic, natural disaster, civil emergency, governmental restriction or supplier failure.

We will take reasonable steps to reduce the effect of the event and will comply with any cancellation or refund right that applicable law provides.

19. Changes to products, services and terms

We may change products, website features and these Terms to reflect legal, security, technical or business developments.

Updated Terms apply to future use and orders placed after they take effect. Changes will not retrospectively remove rights under a contract already accepted unless the change is required by law or expressly agreed with you.

20. Transfer of rights

We may transfer our rights and obligations to another organisation as part of a sale, reorganisation or transfer of the business, provided this does not reduce your contractual or statutory rights.

You may transfer your contractual rights only with our written consent, except where the law gives you a right to transfer them without consent.

21. Severability and waiver

If any provision is found unlawful or unenforceable, it will be treated as modified to the minimum extent necessary or removed. The remaining provisions will continue to apply.

A delay or failure to enforce a right does not waive it.

22. Entire agreement

These Terms and the policies incorporated into them constitute the agreement concerning the website and each order.

Nothing in this section excludes liability for fraud or prevents a consumer from relying on mandatory rights or on statements that legally form part of the contract.

23. Governing law and courts

These Terms are governed by the law of England and Wales.

If you are a consumer living elsewhere in the United Kingdom or another country, you retain the benefit of any mandatory protections provided by the law of your normal residence and may have the right to bring proceedings in your local courts.

Business customers agree that the courts of England and Wales have exclusive jurisdiction.
